DUI Voids Life Insurance

Much has been written about all of the collateral consequences of a Michigan DUI conviction.  These consequences are those not imposed by the court or the Secretary of State (including driver license sanctions), but instead include things like life insurance, CPL rights, child custody, Canadian travel and the like.

Added the list is the collateral consequence of life insurance cancellation for failing to disclose a DUI conviction.  In a recent published DUI case from North Carolina the court found that in fact An insurer may avoid paying benefits under a policy of life insurance “by showing that the insured made representations which were material and false.”  Furthermore, that there was no way that the insured could have not known or forgotten about the DUI conviction.

In most instances, as with this case, it is the failure to report a DUI conviction that causes the most problems.  This is true with things like law school applications, medical license renewals, and obviously life insurance.

If you are charged with DUI in Michigan, and are trying to decide if you should fight the case or just plead guilty, make sure you consider ALL of the consequences, including the collateral consequences.
